This Privacy Policy (the "Policy") defines the practices of Testing Solutions LLC, private limited liability company incorporated under laws of the State of Delaware, company address: 8 The Green, Suite R, Dover, 19901, United States of America (the "Platform Operator," "We," "Our," or "Us") regarding the collection, use, disclosure, and protection of your personal information as a user ("You") of the website www.yourmindsketch.com (the "Website"), the related software application (the "Application"), and any associated services (collectively, the "Services"). The Platform Operator operates the Website, provides the technical platform, manages user accounts, subscriptions, and payment processing, and generates pencil-style drawings from your quiz answers ("Sketches").
When you visit the Website, complete quizzes, request Sketches, purchase a trial membership (the "Trial Membership") or subscription (the "Subscription"), or otherwise use the Services, your use of the Services is governed by this Policy and by our Terms and Conditions (the "Terms"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by both the Policy and the Terms.
We are committed to protecting your privacy and handling your personal data in a transparent and secure manner, in full compliance with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and applicable national data protection laws. Where applicable, we also process personal information of users located in the United States in accordance with applicable U.S. federal and state privacy laws, including, where relevant, the California Consumer Privacy Act ("CCPA") as amended by the California Privacy Rights Act ("CPRA").

1. Personal Information We Collect
Personal Information You Provide to Us
1.1. For the purposes of this Policy, "personal information" means any information that identifies you or can reasonably be linked to you. To provide access to the Website, the Application, and the Services, and to fulfil our contractual and legal obligations, the Platform Operator collects and processes the following categories of personal information that you provide directly:
1.1.1. your email address and, where applicable, your name and other contact details used to create and manage your Account and to deliver Sketches to you;
1.1.2. the answers you give when completing quizzes through the Application — for example the features, style, setting, colours, or personality you describe for a soulmate, dream home, dream car, dream pet or other quiz subject — and, where a quiz asks for it, your own gender or age range;
1.1.3. the Sketches generated from your answers, the written drawing brief derived from your answers that is used to generate each Sketch, and the generation status and timestamps associated with each Sketch;
1.1.4. payment-related information necessary to process Trial Memberships and Subscriptions, cancellations, refunds, and fraud prevention activities, including transaction identifiers, billing details, payment status information, tokenized payment credentials, payment processor identifiers, and related transaction metadata (payment card data is processed directly by third-party payment service providers and is not stored by the Platform Operator);
1.1.5. records of your communications with us, including customer support inquiries, cancellation requests, refund requests, and feedback.
1.2. Quiz answers are intended to describe an imagined subject, not a real person. Please do not enter the name, contact details, or other identifying information of any real person into a quiz. If you do, we process that information only to generate the requested Sketch and treat it under this Policy in the same way as your other answers.
1.3. You are responsible for ensuring that all personal information you provide is accurate, complete, and kept up to date, and for maintaining the security of your device, internet connection, and Account credentials.
Information Collected Automatically
1.4. When you access or use the Website or the Application, we may automatically collect certain technical and usage-related information, including:
1.4.1. device type, browser type, operating system, and unique device identifiers;
1.4.2. IP address and general location information derived from such IP address;
1.4.3. information about how you interact with the Website and the Services, including pages viewed, quizzes started and completed, Sketches viewed or downloaded, session duration, and navigation paths;
1.4.4. information collected through cookies and similar tracking technologies.
1.5. This information is collected to operate the Services, ensure security, analyse performance, and improve the user experience. Quiz progress is also stored locally in your browser so that you can resume a quiz you have started.
1.6. We may receive personal information from third-party service providers and partners that support the operation of the Services, including payment processors, billing providers, analytics providers, fraud prevention services, hosting providers, image generation providers (for example, generation status and content-safety signals), and customer support tools. Such information is processed only for the purposes described in this Policy and in accordance with applicable law.
1.7. For users located in the United States, and within the last 12 months, the Platform Operator may have collected the following categories of personal information, as defined under applicable U.S. privacy laws, including CCPA as amended by the CPRA:
1.7.1. identifiers, such as email address, IP address, and similar identifiers;
1.7.2. commercial information, including records of Trial Memberships and Subscriptions purchased and Sketches generated;
1.7.3. internet or other electronic network activity information, including interactions with the Website and Application;
1.7.4. general geolocation data derived from IP address;
1.7.5. customer service and communications information;
1.7.6. payment, billing, Subscription renewal, and transaction information processed through secure third-party providers;
1.7.7. quiz answers and the Sketches generated from them, and any inferences that could be drawn from them about your preferences.
1.8. Quiz answers may in some cases reveal information about your preferences, relationships, or characteristics (for example, the gender of the soulmate you describe) that is treated as sensitive under certain laws. We process such answers solely to generate the Sketch you requested and to provide the Services, on the basis of your explicit consent given when you choose to submit them. We do not use quiz answers to build advertising profiles.
2. How We Use Your Personal Information
2.1. We process your personal information for specific and legitimate purposes related to the operation of the Website, the Application, and the provision of the Services, limited to what is necessary and proportionate.
2.2. Generating your Sketches. We use your quiz answers to compose a written drawing brief, transmit that brief to a third-party artificial-intelligence image generation provider, receive the rendered Sketch, store it in your sketchbook, and deliver it to you on the Website and by email. This processing is necessary for the performance of the contract between you and the Platform Operator.
2.3. Providing the Services. We use your personal information to provide, operate, and maintain the Website, the Application, and the Services, including enabling you to complete quizzes, access your sketchbook, and use features available under the active Trial Membership or Subscription.
2.4. Account and communications. Personal information is used to create and manage your Account, authenticate access, provide login credentials, and communicate with you regarding your Account, including Sketch-ready notifications, order confirmations, service-related notices, security alerts, billing information, cancellation confirmations, refund-related communications, and customer support responses. Where communications relate directly to the provision of the Services, processing is based on contractual necessity; for general inquiries initiated by you, processing is based on our legitimate interest in maintaining service quality.
2.5. Payments and billing. We process personal information necessary to facilitate payments, manage Trial Memberships and Subscriptions, process renewals, cancellations, refunds, chargeback management, fraud prevention, and billing administration. This may include sharing tokenized payment credentials, transaction identifiers, payment status information, and billing metadata with authorized payment processors, billing providers, acquiring banks, and fraud prevention services. Full payment card details are processed securely by third-party payment service providers and are not stored by the Platform Operator.
2.6. Quality and safety of Sketches. We may review drawing briefs and Sketches — in pseudonymized form wherever practical — to monitor generation failures, detect misuse of the Services (for example, attempts to generate prohibited content), evaluate and improve our prompt templates and drawing styles, and choose which quizzes to offer. This processing is based on our legitimate interest in operating a safe, reliable creative service. We do not use your Sketches to train our own or any third party's image generation models.
2.7. Analytics and improvement. We use technical and usage-related information to analyse how users interact with the Website and the Application, monitor performance, troubleshoot issues, and improve the functionality, usability, and security of the Services, based on our legitimate interests.
2.8. Security and enforcement. Personal information may be processed to protect the Website, the Application, and users against fraud, unauthorized access, misuse, and other unlawful or abusive activities, including monitoring transactions, enforcing the Terms, and investigating chargebacks or unauthorized transaction disputes.
2.9. Legal compliance. We may process personal information to comply with applicable laws, regulations, court orders, or lawful requests from authorities, as well as to establish, exercise, or defend legal claims, including for accounting, tax, and record-keeping purposes.
2.10. Marketing. Where permitted by applicable law, and subject to your preferences and consent where required, we may use your contact information to send you marketing or promotional communications related to the Services, such as new quizzes or drawing styles. You may opt out at any time using the unsubscribe mechanism in the messages or by contacting us directly. Opting out of marketing does not affect service-related communications such as Sketch-ready notifications.
2.11. Sketch generation is an automated process, but it does not produce legal or similarly significant effects on you. Apart from limited automated fraud and content-safety checks, we do not use automated decision-making that produces legal or similarly significant effects on you solely by automated means.
3. How We Share Your Personal Information
3.1. We share personal information only where necessary to operate the Website and the Application, provide the Services, fulfil contractual obligations, and comply with applicable law, in accordance with the principle of data minimization and subject to appropriate safeguards.
3.2. Image generation providers. To draw your Sketch, we transmit the drawing brief derived from your quiz answers to a third-party artificial-intelligence image generation provider. The brief describes the imagined subject (for example, hair, expression, style, setting); it does not include your name, email address, or payment information. Providers process this data as our processor to render the image and to apply content-safety checks, under contractual terms that restrict use of your data to providing the service to us. Providers may be located in the United States; see Section 3.11 on international transfers.
3.3. Storage and delivery providers. Finished Sketches are stored with a cloud storage provider and delivered to you through the Website and by a transactional email provider. Sketch files are stored under non-guessable identifiers; the link in your email is intended for you and should not be forwarded to anyone you do not want to see the Sketch.
3.4. Payment providers. We share necessary payment and transaction-related information with third-party payment service providers to authorize and process payments for Trial Memberships and Subscriptions. Payment service providers process personal information in accordance with their own privacy policies and applicable law. The Platform Operator does not store full payment card details.
3.5. We may share personal information with other trusted third-party service providers who perform services on our behalf, including:
3.5.1. hosting, database and cloud infrastructure providers;
3.5.2. customer support and communication tools;
3.5.3. analytics and performance monitoring providers;
3.5.4. fraud detection, security, and compliance services;
3.5.5. billing infrastructure and payment recovery providers.
3.6. These third parties process personal information solely for the purpose of providing services to us and are subject to contractual obligations requiring appropriate confidentiality, security, and data protection measures, including data processing agreements where required by law.
3.7. Where Google services are used in connection with the Website or the Services, including Google Analytics, Google Ads, Google Tag Manager, Google Consent Mode, or similar Google technologies, certain technical information, online identifiers, usage information, cookie data, and conversion-related information may be shared with Google for analytics, measurement, fraud prevention, consent management, website performance monitoring, and advertising attribution. Such data is processed under Google's Business Data Responsibility Terms, available at: https://business.safety.google/privacy/. Your quiz answers and Sketches are not shared with Google for advertising purposes.
3.8. Where permitted by applicable law, we may share limited personal information (never your quiz answers or Sketches) with analytics providers and advertising partners to measure performance, improve the Services, and, where applicable, deliver interest-based advertising. Under certain United States state privacy laws, such disclosures may be considered "sharing" for targeted advertising purposes. Where required by law, you are provided with the ability to opt out of such sharing.
3.9. We may disclose personal information where required to do so by law, regulation, court order, or lawful request from public authorities, or where necessary to enforce the Terms, investigate potential violations, prevent fraud or security incidents, or protect the rights, property, or safety of the Platform Operator, users, or others.
3.10. If the Platform Operator is involved in a merger, acquisition, reorganization, financing, bankruptcy, or sale of all or part of its assets, personal information may be disclosed or transferred as part of that transaction, subject to appropriate safeguards and in accordance with applicable law.
3.11. International transfers. Some of our providers, including image generation and cloud infrastructure providers, are located outside the European Economic Area, in particular in the United States. Where personal data of EEA or UK users is transferred to such providers, we rely on an adequacy decision (including the EU–U.S. Data Privacy Framework where the provider is certified) or on Standard Contractual Clauses approved by the European Commission, together with additional safeguards where appropriate.
3.12. Within the last 12 months, personal information may have been disclosed to the following categories of recipients: image generation providers, cloud storage and email delivery providers, payment service providers, billing infrastructure providers, hosting, infrastructure and IT service providers, analytics and performance measurement providers, advertising partners (where applicable), customer support providers, and legal, compliance, and fraud prevention partners.
4. Your Rights And Choices
4.1. Depending on your place of residence and applicable data protection laws, you may have certain rights regarding the personal information we process about you. These rights may vary by jurisdiction and are subject to legal limitations and exceptions.

4.2.6. Right to object – to object to processing based on legitimate interests, including processing for direct marketing purposes and quality-review of Sketches;
4.2.7. Right to withdraw consent – where processing is based on your consent, including the processing of quiz answers, to withdraw such consent at any time without affecting the lawfulness of processing prior to withdrawal. Withdrawing consent may mean that we can no longer generate or keep Sketches for you.
4.3. If you are a resident of the United States, and where applicable under U.S. federal or state privacy laws (including the CCPA as amended by the CPRA), you may have the following rights, subject to applicable limitations:
4.3.1. Right to know and access the categories and specific pieces of personal information collected about you;
4.3.2. Right to delete personal information collected from you, including Sketches, subject to legal exceptions;
4.3.3. Right to correct inaccurate personal information;
4.3.4. Right to opt out of the sale or sharing of personal information for targeted advertising purposes, where applicable;
4.3.5. Right to limit the use or disclosure of sensitive personal information, where applicable;
4.3.6. Right to non-discrimination for exercising your privacy rights;
4.3.7. Right to opt out of certain uses of personal information related to targeted advertising, analytics sharing, or cross-context behavioural advertising, where such rights are provided under applicable U.S. state privacy laws.
4.4. We do not sell personal information for monetary consideration and we do not sell or share your quiz answers or Sketches. Certain disclosures of technical identifiers to analytics or advertising partners may be considered "sharing" under applicable U.S. state law.
4.5. To exercise any of your rights, please contact us using the contact details provided in the Contact Information section of this Policy. We may require additional information to verify your identity before processing your request. Deleting a Sketch is permanent and cannot be undone; we recommend downloading any Sketch you want to keep before requesting deletion.
4.6. We may decline or limit requests where permitted by law, including where a request is manifestly unfounded, excessive, repetitive, or would adversely affect the rights and freedoms of others.
4.7. Where permitted by applicable U.S. law, you may designate an authorized agent to submit a request on your behalf. We may require proof that the agent is authorized to act for you and may require you to verify your identity directly with us.
4.8. We will respond to verified requests within the timeframes required by applicable law. Where permitted or required, you may have the right to appeal our decision regarding your request; instructions for submitting an appeal will be provided in our response.

5.1. 7. Security And Retention of Your Information

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM LIABILITY for any unauthorized access, hacking, data loss, or other security incidents resulting from causes beyond our reasonable control, including criminal acts of third parties, sophisticated cyber-attacks, vulnerabilities in third-party software or infrastructure, or failures of internet, storage, image generation, or payment service providers.
7.3. You are solely responsible for maintaining the security of your devices, network connections, and Account credentials, and for who you choose to share a Sketch or a Sketch link with.
7.4. We retain personal information only for as long as is reasonably necessary to fulfil the purposes for which it was collected, including to provide the Services, keep your sketchbook available to you, manage Accounts, recurring Subscriptions, billing disputes, chargebacks, and fraud prevention activities, comply with legal and regulatory obligations, resolve disputes, and enforce the Terms.
7.5. In particular: quiz answers, drawing briefs and Sketches are retained for as long as your Account exists so that your sketchbook remains available to you, and are deleted or anonymized within a reasonable period after your Account is deleted or after you request deletion of a Sketch. Image generation providers retain the drawing briefs we send them only for the period required to render the image and to meet their own abuse-monitoring and legal obligations, as described in their terms. Transaction and billing records may be retained for longer periods where required by law or for accounting, tax, chargeback handling, or legal compliance purposes.
7.6. For users located in the United States, personal information is retained for as long as reasonably necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and protect our legal rights.
7.7. While we take reasonable steps to protect personal information, you acknowledge that the Platform Operator cannot guarantee absolute security, and you use the Services at your own risk.
8. Our Data Policy on Children
8.1. The Website, the Application, and the Services are intended solely for individuals who are at least eighteen (18) years old. By accessing or using the Services, You represent and warrant that You are at least eighteen (18) years old.

Quizzes must not be used to describe or generate images of minors.

If the Platform Operator becomes aware that an individual under the age of eighteen (18) has provided personal information, created an Account, or otherwise used the Services, it may, at its sole discretion, delete the relevant personal information and Sketches, suspend or terminate the Account, and restrict further access to the Services.
8.4. The Platform Operator reserves the right to implement reasonable age-verification, identity-verification, account-authentication, payment-verification, fraud-prevention, or eligibility-verification measures to confirm compliance with this Policy and the Terms.
